Thanks for the link. It’s very clear the easement “runs with the land”. This is why people need to read the legal documents before they make comments that aren’t true. We do need to watch that no dock is built at this site.
I see the comment of run of land. DLPOA has always maintained upkeep of that property and the house has been a rental for years…which had boats moored there that were not in his name. Its sad that the person who cost our association extra lawyer fees from not approving the launch will profit. I just hope the realtor lets a buyer know there will never be a dock allowed there. That was decided so our association could not be held liable for any injuries.

“All sports Duck Lake! Amazing opportunity! Ranch with large lot on Divista Dr. that has 30 ft +- easement directly across the street to provide mooring space at Duck Lake shoreline of easement for water craft owned by owner (constant judgement)”
The use of the easement is for the existing owner of that house only. If the house ever sold that home looses that right. It was voted in before the boat launch was put in because that owner would not approve the launch. It should be documented somewhere in the original papers when Jim Heiglener was the president of the association. We needed permission from 300′ of homeowners around the launch. It was specified that if that owner sells they loose that right to use that property.
It was meant only for that homeowner. It was supposed to be stated that if the house sold that land will always be owned by Duck Lake. During that same time before the launch was put in the DNR wanted to buy that easement and pay for their own launch to allow 5 boats at a time entry. We strongly voted that down…we were not going to let the DNR turn our lake public. The only way that homeowner stopped fighting our launch was to give him access to let him leave his boat there…only as long as he owned the house. I dont believe he was ever deeded the property.
Just read Maureen’s comment. Have the bubblers started? If so the one closest to the Chevron bridge isn’t working. I thought I saw it working for a short time yesterday and then 10 minutes later it wasn’t on so I thought maybe it was just a test. If it’s supposed to be on now, it isn’t. Thanks.
A big shout out to Mike Ricard from those of us on the White lake road side of Duck Lake. I called you Monday to report our bubblers not working. You said they’d be fixed by Friday. It’s Thursday afternoon and they are up and running. Thank you for your help and quick response.
Hi. I was told there was talk of adding bubblers through the middle. These really needs to happen. My muck has gotten so much worse and I have my own system I try to fight it with. It has all moved to my house and my neighbors and settled. I can’t even start my Jetski because the intake immediately sucks it in and destroys the engine. I spoke with Ryan, the WRC Lake Level Engineer this morning. I relayed on behalf of the DLPOA our request to bring the dam boards up to normal summer level. He said they are a month away from raising the Oakland County dams to full summer level anticipating the normal spring precipitation. They are more concerned from repercussions of spring flooding than potentially low lake levels. A fine balancing act on their part. He did say that in light of low levels last year, they will begin adding some boards to all dams very soon, ahead of the normal schedule. He also said they will begin testing all of the well pumps for proper operation.
The lake level on 3/15 (Monday) was 4.5″ below legal summer level, and 6.5″ above where most of you would like the summer lake level. I suggest that we all take this opportunity to clean our beaches, raking any leaves out to high ground to dry in anticipation of leaf collection beginning hopefully April 1st.

I always thought that as well. The court order seems to say otherwise. I believe “runs with the land” means the rights transfer with the property.
